Terms of Service

By registering for, or using Atabook, you agree to the terms below. If you do not agree to the terms below, please do not use the service.

Definitions

The terms "us", "we", "our", and "Kicya" refer to the owner of the Service, Kicya LLC, a Wyoming limited liability company.

The terms "you", "your", and "user" refer to the person who uses the Service.

The term "Atabook" refers to the service provided by Kicya.

Eligibility and Age

You must be at least 13 years old to register for a Atabook account, or older if the minimum age of digital consent in your country is higher than 13. By registering, you confirm that you meet this requirement.

Governing Law

These Terms of Service and any dispute arising from or related to the use of the Service shall be governed by and interpreted in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Recurring Payments

If you purchase a paid subscription, payments may be processed as recurring charges through our third-party payment provider, Stripe. By subscribing to a paid plan, you authorize us and Stripe to charge your selected payment method automatically according to the billing cycle shown at the time of purchase (for example, monthly or yearly) until the subscription is canceled.

All payment processing, billing, refunds, and dispute handling related to card transactions are performed by Stripe and are subject to Stripe’s own terms and policies. By completing a purchase, you also agree to the Stripe Services Agreement and related legal terms available at https://stripe.com/legal.

You are responsible for ensuring that your payment information is accurate and up to date. Failure to successfully process a recurring payment may result in suspension or termination of the paid subscription.

Refunds

Refunds are provided on a case-by-case basis and may be denied at the discretion of Kicya. If you are not satisfied with the service, please contact us using this contact form.

Nothing in this section limits any non-waivable consumer rights under the laws of your country of residence.

Compliance

The Service is operated in compliance with the laws of the United States of America. Users are required to use the services in accordance with the laws of the United States of America and their local laws.

Disclaimer

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Kicya be liable for any claims, damages, or other liabilities, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Service or the use or other dealings in the Service. The terms of this section will survive any termination of this agreement.

Termination of Service

We reserve the right to terminate your account at any time, for any reason, without notice. Examples of reasons for termination include:

• Violation of the usage policy
• Content against the law
• Creating more than 3 accounts per person. You can create multiple guestbooks with Atabook Supporter plan.

Usage

We won’t allow users involved in the following activities and/or affiliated with 3rd party websites involved in the following activities: spam, erotic content, sex, illegal sale of medicine, online gambling, hate, harrassment, using and/or offering illegal software/media, hacking, cracking, pyramid schemes, cults, cons, or other illegal activities.

You, as a user, are responsible for all content of your guestbook (this includes visitors messages).

You also agree to not publish personal information of visitors (email addresses, IP addresses, etc.).

Damage

Any damage to Atabook, including damage to third party websites, software, hardware, or other products or services, is not permitted.

DMCA

Kicya LLC respects the intellectual property rights of others. Per the DMCA, we will respond expeditiously to claims of copyright infringement on the Site if submitted to our Copyright Agent as described below. Upon receipt of a notice alleging copyright infringement, We will take whatever action it deems appropriate within its sole discretion, including removal of the allegedly infringing materials and termination of access for repeat infringers of copyright-protected content.

If you believe that your intellectual property rights have been violated by us or by a third party who has uploaded materials to our website, please provide the following information to the designated Copyright Agent listed below:

• A description of the copyrighted work or other intellectual property that you claim has been infringed;
• A description of where the material that you claim is infringing is located on the Site;
• An address, telephone number, and email address where we can contact you and, if different, an email address where the alleged infringing party, if not we, can contact you;
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner or other intellectual property rights owner, by its agent, or by law;
• A statement by you under penalty of perjury that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf;
• Your electronic or physical signature.

Kicya LLC may request additional information before removing any allegedly infringing material. In the event we remove the allegedly infringing materials, we will immediately notify the person responsible for posting such materials that we removed or disabled access to the materials. We may also provide the responsible person with your email address so that the person may respond to your allegations.

Limitation of Liability

Under no circumstances, including negligence, will Kicya or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of or inability to use the Service. This includes, but is not limited to, reliance on any information obtained through the Service, as well as damages resulting from mistakes, omissions, interruptions, deletion of files or emails, loss of or damage to data, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not caused by acts of God, communication failures, theft, destruction, or unauthorized access to Service records, programs, or services. You acknowledge that this provision applies whether or not Kicya is notified of the possibility of such damages, and it covers all content, merchandise, or services available from Kicya or its affiliates. The terms of this section will survive any termination of this agreement.

Changes to the Agreement

We reserve the right to change the terms of this agreement at any time. By using Atabook, you agree to be bound by the terms of this agreement.
